By Barry Zalma, Esq. - September 3, 2010My colleague, Larry Rojak, in New York recently, blogged that two years ago, the Court of Appeals held in Fair Price Medical v. Travelers Insurance Corp. that a medical provider which submits fraudulent billing to a no-fault insurer is entitled to be paid, even for services it never actually provided, unless the no-fault insurer discovers the fraud within 30 days of submission of the bill and issues a denial based on that fraud. In the case reported here, that principle – that no-fault fraud is basically legal in New York – is once again applied. This case stands for the principle that the no-fault insurer cannot even amend its Answer to include a counterclaim for unjust enrichment because it did not assert the fraud defense in its denials. The man in question behind Kelly Soo Park and the 2008 murder of 21-year-old actress and model Juliana Redding in Santa Monica, California, is Dr. Munir Uwaydah, a workers’ compensation treating doctor who is known in the workers’ compensation industry for his flagrant acts of fraud, not only in workers’ comp and in the greater medical insurance system, but in general, as he has been found liable in court decisions as responsible for stealing a scanner from General Electric Medical Systems Europe in 2002 and to have ripped off General Electric for over 900,000 dollars.

Fraudulent Slips-And-Falls Up 57% In Past Two-And-A-Half Years By Lonce LaMon - August 30, 2010According to Claims Magazine – www.claimsmag.com-- in their August 24th article, a 57 percent increase in questionable slip-and-fall claims have been submitted to the National Insurance Crime Bureau over the past two-and-a-half years. The NICB reported 4,600 questionable claims as potentially fraudulent were submitted by member companies from the beginning of 2008 through the first six months of 2010.
Joe Wehrle, the president and chief executive officer of NICB, explained that, “While many people have legitimate accidents in stores and businesses across the county, we’ve seen a growing number of cases that have some indication of potential fraud.”

Some pundits are saying it will take several more years for our nation to get back to an unemployment rate of 5%, and until that happens, profitability in workers’ compensation insurance will be nothing to write home to Mom about.
Robert P. Hartwig, Ph.D., speaking two weeks ago at the Florida Workers’ Compensation Institute’s annual Workers’ Compensation Educational Conference, emphasized that the demand for commercial insurance has dropped as unemployment has risen. “Nationwide, we lost about 8.4 million jobs from December 2007 through December 2009. The recession caused the largest impact on workers’ compensation exposure in 60 years.”
